
Shimla, Nov 17: More than Two weeks alleged intimidation and complaints of threat to life of a businessman, Kangra Police booked two unknown persons in the dispute between Himachal Pradesh Director General of Police (DGP) Sanjay Kundu and businessman Nishant Sharma.
Soon after Division bench of chief Justice MS Ramachandra Rao and Justice Jyotsna Rewal Dua questioned the inaction of the state government and police on the complaints of businessman Nishant Kumar Sharma Kanga police registered an FIR against two unanimous persons. According to a media statement issued by the Kangra police on Thursday FIR has been registered on the complaint received from Nishant a businessman belonging to Himachal, who has informed the police having being threatened by some people by blocking his path in Bhagsunag, Dharamshala on October 27. He complained about this to Kangra Police on 28 October.
It seems that police was moving with snail pace to protect the top cops from their alleged involvement or connivance of state police forces was inhesitent to lodged FIR immediately after complaint almost took 21 days to go ahead with FIR .
The state government which is sofar refraining to mention the name and designation of top cops in the matter was rebuked of the High Court during a hearing in Himachal Pradesh High court on Thursday.
According to the police press statement ,an FIR under sections 341, 504, 506, and 34 of the Indian Penal Code (IPC) has now been registered in this case. Importantly, section 341 of IPC has been imposed for wrongfully blocking the way, Section 504 for abusive words, Section 506 for criminal intimidation and IPC Section 34 for involvement of two or more people.
Himachal Pradesh High court has also appointed advocate Neeraj Gupta as an amicus curries in the matter to assist the court on behalf of complaints.
A status report was filled by the SP Kanga in the matter before the high court Thursday and Advocate General Anup Rattan stated in that SDPO Jawalamukhi Vikas Dhiman would ensure to register FIR with regard to the complaint made by the complainant dt. 28.10.2023 to the Senior Superintendent of
Police, Kangra, at the earliest.
The police will now investigate the allegations made in Nishant’s complaint in this case. In this complaint, Nishant has mentioned about threatening by blocking the road, getting a call from DGP Sanjay Kundu on the same day and calling him to Shimla and some people forcefully selling the company’s property. In the complaint given to SP Kangra on October 28, Nishant has stated that there is a threat to his and his family’s life.
A senior advocate of the High Court said it will depend on the police investigation as to whom FIR will be registered. FIR should be lodged against those whose names will appear in this case. He told that whether a case is made against DGP or not is also the domain of the police. The police would have to conduct an impartial investigation in this matter, because the High Court is monitoring this matter.
In the DGP and Nishant Kundu case, the High Court has ordered to provide police protection to the businessman’s family. Also, this matter will now be heard in the High Court on November 22.
Citing a Supreme Court case, the High Court said any complaint should be immediately investigated by registering an FIR.
In fact, on August 25, there was a fatal attack on Nishant Sharma’s family in the courtyard of their house in Noida.
Nishant and his two and a half year old son were injured in this. Its CCTV footage is also available. Haryana Police is investigating this matter. Nishant said in a press conference that the Noida attack accused has links with retired bureaucrats from Himachal.
Therefore, after Noida, on October 27, his road was blocked at Bhagsunag in Dharamshala and he was threatened.
After Bhagsunag incident Nishant stated in the complaints that DGP Sanjay Kundu called him. repeatedly called Shimla, while he did not commit any crime. Similar call was also received from the police others officers to Nishant.
DGP Sanjay Kundu has lodged an FIR in Chhota Shimla on November 4 After this FIR, Nishant gave another complaint to SP Shimla and demanded registration of FIR against DGP.
