IndiGo Sues Mahindra Over '6E' Trademark Use in New Electric SUV

IndiGo, India’s largest airline, has initiated legal proceedings against Mahindra Electric Automobile Limited, claiming infringement over the use of ‘6E’ in the branding of Mahindra’s new car model, BE 6e. The airline contends that ‘6E’ is its proprietary callsign and an integral part of its branding, widely recognized through services like 6E Prime, 6E Flex, and 6E add-ons.

The Dispute

According to a report by Bar and Bench, IndiGo has alleged that Mahindra’s usage of ‘6E’ in the BE 6e compact SUV dilutes its trademark and creates consumer confusion. IndiGo’s trademarked ‘6E Link,’ registered in 2015 under various classes related to advertising and transport services, is central to its case.

In contrast, Mahindra registered the ‘BE 6e’ trademark under class 12 on November 25, 2024, allowing its use for a wide range of vehicles, including cars and two-wheelers.

Upcoming Hearing and Developments

The lawsuit, filed on December 4, 2024, is set for a hearing on December 9. However, Justice Amit Bansal has recused himself from the case. Mahindra has reportedly reached out to IndiGo to discuss a resolution, as stated by Senior Advocate Sandeep Sethi, representing the airline.

Mahindra’s BE 6e is a sporty compact electric SUV set to launch in February 2025. Priced at ₹18.90 lakh (ex-showroom), it is positioned to compete with the Tata Curvv EV, MG ZS EV, and Hyundai Creta EV.

The outcome of this legal dispute will determine whether Mahindra can continue using ‘6E’ as part of its branding for the BE 6e, or if it must rebrand its upcoming vehicle to avoid infringing IndiGo’s trademark rights.
